Ferrari Testarossa trademark annulled for lack of use now reinstated
In 2017 Kurt Hesse argued that Ferrari had not made genuine use of the Testarossa trademark between 2010 and 2015.
The court agreed and revoked the trademark, citing a lack of commercial activity under the name during that period.
2nd July 2025 the court over turned this earlier ruling, because although not making new cars the second-hand market was alive, and Ferrari continued to certify and authenticate genuine cars and parts. This was deemed to constitute genuine and continued use of the trademark!
There have been a few recent high profile trademark challenges for lack of use, it is good to use this iconic trademark Testarossa back where it belongs.
