You might even have a registered trademark but if Facebook decide to use your trademark Meta what are you really going to do?
The current case in the US has Perplexity AI launching consumer-based a search platform called ‘Comet’, which has caused consternation to Comet ML who offer specialised AI tools, and had traded for 6 years prior under the name.
Here a Californian judge ruled that Perplexity AI could launch its “Comet” search engine, albeit with specific restrictions preventing them from entering Comet ML’s market space.
Whereas a court in Düsseldorf, Germany, ordered Perplexity to cease using the term “Comet” in Germany in connection with AI for web browsers and machine learning!
One issue with AI is that it can extend to a whole range of areas quite quickly.
Whilst it might be cool to grab a name like Comet or Meta, also consider whether you are prepared to defend such a name in a dispute.
Sometimes it might be easier in the long run to come up a with unique name like Rolex and Kodak did all those years ago.
